Akhir akhir ini banyak fenomena yang berurusan pada penegak hukum di indonesia terutama dari sistem cara bekerja penegak hukum , Kita bisa memperhatikan perilaku para penegak hukum seperti yang terjadi pada kasus-kasus yang sedang viral di social media, begitu juga masyarakat yang melihat gejala ini bertindak dan berperilaku menyesuaikan dengan tanggapan mereka lihat dari kasus masyarakat yang sedang viral sehingga juga berusaha memviralkan sesuatu agar hal tersebut menjadi perhatian banyak orang ataupun pihak terkait.

Saat ini media sosial menjadi kekuatan rakyat (people power) yang dominan dalam mempengaruhi penegakan hukum dan keadilan di Indonesia. Melalui Media sosial inilah kekuatan rakyat (people power) memiliki kekuatan baru sebagai penyeimbang terhadap penegakan hukum.

Dalam tindakan ini menimbulkan akibat dari penyaluran suara rakyat melalui media sosial terhadap penegakan hukum di Indonesia cenderung mengarah kepada Trial By The Press seseorang yang sedang mengalami kasus hukum, meskipun belum divonis oleh persidangan namun sudah dicap bersalah oleh masyarakat luas melalui media sosial. Tindakan tersebut cenderung membuat masyarakat untuk menyalahkan seseorang tanpa melihat latar belakang baik berstatus tersangka atau terdakwa. Hal ini diakibatkan hasil pemberitaan yang dilakukan oleh pers terhadap masyarakat , oleh karena itu berhati hati dalam memberikan berita atau informasi mengenai kasus yang terjadi.


Contoh yang terjadi adalah kasus VINA yang sudah ditutup dan kemudian dibuka kembali akibat adanya Pers yang memviralkan kasus tersebut melalui sebuah film. Dari situlah menimbulkan esensi aparatur penegak hukum untuk membuka kembali kasus tersebut karena adanya kekuatan rakyat (people power), yang kemudian munculah jargon NO VIRAL NO JUSTICE.

Namun sebenarnya ini tidaklah terlalu buruk karena dari sini kita bisa melihat integritas aparatur penegak hukum dalam menyikapi kasus – kasus yang dibungkam . Masyarakat berhak menyuarakan hak dan pendapat maupun kritisi mereka sesuai dengan adagium Vox Populi Vox Deiyang yang memiliki arti Suara Rakyat adalah suara Tuhan.


Oleh Karena itu partisipasi masyarakat sangat penting dalam pembentukan kebijakan publik dan mempertahankan prinsip-prinsip demokrasi, mengawasi berjalannya penegakan hukum hingga mempromosikan kesejahteraan dan keadilan sosial. Timbulnya partisipasi masyarakat saat ini disebabkan merosotnya penegakan hukum di negara Indonesia yang dibuktikan dengan penanganan sejumlah kasus-kasus pidana yang viral akhir-akhir ini. Maka tolong untuk aparat penegak hukum harus memiliki integritas dan profesional dalam mewujudkan negara hukum yang efektif dan adil.
